MOTION FOR ORDER OF DEFAULT

Ruston has changed all the lawyers. The main guy is now from Spokane. May be too late to answer as time limit was not met.
Question regarding who got all the money in this fiasco dating back to 2004 I have a Public records request in for 2008 thru 2010.
Also am requesting a copy of 2008 complaint from Steve Fabre for $9 million dollars.
If the Casino gets the old school and the Town Hall in a settlement we may see an expanded trade stimulant business with a view no less. Plenty of new customers when Commencement is filled out.
Things are happening fast on this issue and it appears Town may be on the ropes unless they find a very sympathetic judge and survive appeal, if so.

Jim Hedrick appointed Mayor pro tem

Notably absent Town Attorney David Britton who submitted a letter of Resignation and after a delay was accepted a week ago.
This will be short more details later.

Agenda item No. 1 Ordinance 1328 repealing Ordinance 1316 regarding Social card games (second reading)
Moved to February 7,2010 Town council meeting to allow time for new Town Attorney to review.

Agenda Item No. 2 Resolution 482 Authorizing Mayor to enter into an agreement for Legal Services with Morris Law P.C. for Town Attorney Services
Senior Attorney Carol Morris to be retained by Town of Ruston. Has previous legal experience representing Town of Ruston. Experience as Town Attorney for Town of Eatonville. Has experience small town comes highly recommended. Hired on short contract regarding Ruston Cafe and Casino. Flat rate contract better for Town of Ruston. One of most qualified.

Still hard to hear tried to record it.

Here we go again. So far Ruston has got by on the cheap but that maybe coming to an end with $9 million dollar claim filed plus lawsuit for damages.

Bradley motions to add Agenda item 2 Ordinance No. 1328 Repealing Town of Ruston Ordinance No. 1316 and add Executive Session.
MINUTES - No minutes at this time.
PUBLIC COMMENTS
Jim- Town could of been spared this if public was allowed to comment on BUSINESS items.

Agenda item No. 1 Ordinance 1327 Amending Utility Tax Rates (second reading)
Tabled to next meeting.
Agenda item 2 Ordinance No. 1328 Repealing Town of Ruston Ordinance 1316, and RMC sections 5.02.30, 5.02.40 and 5.02.50 regarding Social Card Games

7:10 EXECUTIVE SESSION 45 minutes reconvene 7:55
7:45 Mayor Hopkins appears to those waiting outside council chambers to announce 15 minute extension.
7:52 Town Attorney David Britton leaves council chambers stands in hallway.
8:00 Council person Bradley Huson emerges to announce second 15 minute extension.
8:15 David Britton opens door to two remaining citizens and Town Clerk.
Next thing I heard was CLAIMS/PAYROLL Passes 5-0.
I cannot hear in this chamber as Town Council et al are up on a stage. Repeated requests to comply with ADA (American with Disabilities Act) have been ignored.
Ordinance 1328 might have been tabled or just disappeared anyway immediately to

TRIAL OF DOOM

or trial of the century for Ruston. This is a biggee and they are all coming back for a curtain call. More details later unable to purchase copies of amended complaint tonight. Trial schedule 06/04/2012.

I may be around for a while longer God willing. Wouldn't miss this for anything, I do think.

Still have to get copy of nine million dollar claim against the Town of Ruston. All done without public comments, when will they ever learn?

Ruston you reap what you sew. After going on seven years of "cabal" rule things are moving to a mutually induced dissolution. Seven years of not allowing citizen comments on Business items has gotten us to this:

After filing a claim for more than $9 million, Fabre has a separate damages suit pending against the town.


Attorney Joan Mell has brought seven to eight (I lost count) lawsuits against Ruston and won everyone!

Remember this started seven years ago with a voter revolt against The Commencement condominiums despite a land sale over four million dollars that has kept the town afloat and paid for huge infrastructre improvements.

But it may all be coming to an end because of a small group of strong willed individuals following a plan to turn Ruston into a bedroom community and hiring their own Special Legal Counsel to advise them.

The members of the council change but their actions to get rid of all businesses are always 5-0.

I wrote the con argument against Ruston Resolution 477 and Referendum number one and very nearly won the day. Now it looks like more millions of dollars going down the drain that could of been used to complete the ongoing infrastructure improvements.

PRO and CON arguments on referendum number one are in prior blog.

Also the main figures in this effort on Ruston's part all refused to return phone calls from The News Tribune.

Will try to get copy of nine million dollar claim against Ruston. Illegal gambling tax invalidated by judge has never been rescinded. Also more information on lawsuit.
